Through its directions dated 27 December 2018, the FSSAI has extended the timeline for the compliance of labeling provisions for the products “Frozen Dessert of Confection” under the Food Safety and Standards (Food Products Standards and Food Additives) Thirteenth Amendment Regulations, 2017.
In October 2017 the FSSAI had notified revised standards for milk and milk products in the Official Gazette of India. According to the notification, a transition period of six months, up to 1 July, 2018 had been given to the Food Business Operators to comply with the revised standards.
Further, a timeline for the compliance of the ‘Labelling’ requirements for regulation under Standard for Frozen Desserts or Confections with Added Vegetable Oil/ Fat or Vegetable Protein, or both (2.1.15) had been fixed till 1 January 2019 as there had been an issue on the nomenclature of these products vis-à-vis ice-cream.
FSSAI has received representations from various stakeholders with requests to extend the time for compliance of the above-mentioned provisions as the issue of nomenclature is still under review in the FSSAI. They also wish to utilize the existing stock of packaging material.
After due consideration the FSSAI has decided to extend the timeline for compliance of the ‘labelling’ requirements for ‘Frozen Desserts or Confections with Added Vegetable Oil/ Fat or Vegetable Protein, or both’ in the above mentioned regulations for a period of six months up to 1 July 2019 or till further order, whichever is earlier. However, the Food Business Operators are required to comply with all other standards/labeling provisions specified for the said products under these regulations.
Difference Between Frozen Dessert and Ice-Cream
According to the Food Safety and Standards Authority of India, the definition of an ice cream, kulfi or softy ice cream means that the product is obtained by freezing a pasteurized mix, prepared from milk and /or other products derived from milk with or without the addition of nutritive sweetening agents, fruit and fruit products, eggs, etc.
Frozen Dessert or Frozen Confection means the product obtained by freezing a pasteurized mix prepared with edible vegetable oils or fats, having a melting point of not more than 370 C or vegetable protein products, or both. It may also contain milk fat and other milk solids with the addition of nutritive sweeteners and other permitted non-dairy ingredients. The said product may contain incorporated air and may be frozen hard or frozen to a soft consistency.
Therefore, as per regulations Ice Creams do not contain edible vegetable oils or fats or vegetable proteins but Frozen Desserts do.
