
FSSAI had earlier introduced self declaration in place of affidavit for Product Approval and Licensing. Keeping in mind the Order, O.M. No. Z.17015/1/2014-CD N-I, dated 17th October, 2014 issued by the Government of India, Ministry of Health and Family Welfare the FSSAI is now introducing the ‘Undertaking by way of Self Declaration’ as a replacement for ‘Affidavits’ in the Food Import Clearance System also.
Accordingly those Food Business Operators who wish to apply for the Food Import Clearance System will now have to provide ‘Undertaking’ on plain paper. There is no longer any requirement to submit an ‘Affidavit’ along with the application as per FSSAI notification dated 27th March 2015.
Earlier affidavits were to be made as per guidelines issued by FSSAI No. 1/ 2008/ Import Safety/ FSSAI-Vol. JI dated 12.10.2011. However, now FSSAI has changed the requirement for affidavit. The FSSAI has also prepared new formats for the ‘Undertakings’ to substitute the ‘Affidavits’ that are required for Food Import Clearance System.
- Annexure 1 of the official doc from FSSAI contains the ‘undertaking’ that is required for issue of provisional NOC for imported food consignments that have less than seven days of shelf life.
- The Undertaking for the issue of provisional NOC for frozen and chilled imported food consignments is given in Annexure 2 of the original doc. from FSSAI.
FSSAI has also introduced some other new ‘Undertakings’ that will make it possible to have a hassle free process and there will be ease of doing business. The New Undertakings have been created for the following in a new format.
- Undertaking from importers for imported food consignment meant for Display Purpose in Trade Fair/Exhibition (Format available in Annexure 3 of the official doc.)
- Undertaking from the importers for imported food consignments meant for personal use (Format available in Annexure 4 of the official doc.)
- Undertaking from importers for imported food consignment containing bulk packages and not having representative sample (Format available in Annexure 5 of the official doc.)
- Undertaking from importers for imported food consignment containing bulk packages and having representative sample (Format available in Annexure 6 of the official doc.)
- Undertaking from importers for imported food consignment meant for Research & Development purposes (Format available in Annexure 7 of the official doc.)
- Undertaking from importers for imported food consignment meant for 100% Export / Re-export (Format available in Annexure 8 of the official doc.)
- Undertaking from importers for imported food consignment meant for Sports Events (Format available in Annexure 9 of the official doc)
- Undertaking for imported food consignment meant for accelerated clearance by an Accredited Importer (Format available in Annexure 10 of the official doc)
- Undertaking for imported food consignment meant for accelerated clearance by Importer (Format available in Annexure 11 of the official doc)
With immediate effect those Food Business Operators who wish to apply for Food Import Clearance System will now have to do so according to the Undertakings by way of self declaration according to the type of imports they are applying for and according to the new format of the new ‘Undertaking’ that FSSAI has made. FSSAI will not be accepting any notarized affidavits any more as from 1 April 2015.
