FSSAI has issued directions dated 25 September regarding Form of Notice (Form VA) to the Food Business Operator.
FSSAI has drawn attention to the provisions of the Rule specified under “2.4.1: procedure for taking sample and manner of sending analysis” of FSS Rules, 2011 which specifies the procedure to be followed by the Food Safety Officer while taking sample of food for analysis under clause A of Sub Section 1 of Section 38 and Section 47 except 47 (5) of the FSS Act, 2006.
The said provisions under Rule 2.4.1 (3) mandates that the Food Safety Officer shall have to serve the notice in form VA to the food business operator then and there. The form shall clearly specify the parameters to be tested
- 1 As per FSSAI standards for the specific products
- 2 Any additional test to be performed if any
The FSSAI has advised the Commissioners of Food Safety of All States and UTs and all central Licensing Authorities to ensure that the provisions of Rule 2.4.1(3) are strictly adhered to and that the parameters of the food sample to be tested are clearly specified, this includes any additional test to be performed, if any, then and there at the time of lifting the samples.
