Food Safety and Standards Authority of India (FSSAI) has drafted a new framework termed as FSS (Health Supplements, Nutraceuticals, Food for Special Dietary Use, and Food for Special Medical Purpose, Prebiotic and Probiotic Food) Regulations 2022.
The notion behind such overhaul is to make it unambiguous and clear. This regulation is in reference to section 92 of Food Safety and Standards (FSS) Act 2006(34 of 2006).Food Safety and Standards (Health, Supplements, Nutraceuticals, and Food for Special Dietary Use, Food for Special Medical Purpose, Functional Food and Novel Food) Regulations 2016.
Notably, the draft regulation is in the process of draft publication and its final notification is in the offing. Consequently, FSSAI has decided to operationalize the provisions of these regulations as per Annexure 1 with effect from 1st April 2022.
The schedules as applicable to different categories of these regulations are enclosed in Annexure 2. The list of additives and purity criteria is enclosed in Annexure 3 .
It is important to note here that FSS(Nutra) Regulations 2022 will supersede FSS (Health Supplements,
Nutraceuticals , Food for Special Dietary Use, Food for Special Medical Purpose , Functional Food and Novel Food) Regulations 2016 and any amendments made thereunder.
The apex body of food safety has issued the above directions with the approval of the competent authorities in exercise of the power under section 18(2)(d) with 16(5) of Food Safety and Standards Act 2006.
