All hotels, restaurants, catering services, clubs, canteens, retailers, suppliers, food transporters, wholesale traders, distributors, cold storage and warehouse owners need to apply for a license from FSSAI before they commence their business. All FBOs who own any of the following businesses related to food like milk collection and chilling centers, solvent extracting and oil refining units, importing, manufacturing, processing, packaging, re-labeling businesses that deal with food need to have a license.
You may not commence your business without a license. However, if 60 days have expired from the date of application and you have not yet received the license you are permitted to begin your business if you have been given an application ID number. If your application is complete in all respects then the inspectors will come to inspect your premises. If your application is incomplete then after 15 days of applying for license you will be advised in writing to complete the incomplete application. Make sure you furnish all information as required or your application could be rejected. Once the Licensing Authority has issued a License then a true copy of the License has to be displayed in a prominent place in your premises.
The Documents required for Licensing or Renwal of License are many so make sure you have them all when you apply for the license along with application fee
- Completed and signed form Form-B in duplicate. Form B has to be signed either by you the proprietor or your partner or the authorised signatory as is applicable for some businesses like import business.
- Blueprint/layout plan of the processing unit showing the dimensions in metres/square metres and which clearly shows which area you have allocated for what purpose.
- Complete list of Directors with full address and contact details
- A list that gives the name of equipment and machinery you will use, the number used, installed capacity as also the horse power that will be used to run the machines.
- As a business owner you have to provide a photo ID and address proof that has been issued by any Government Authority. If you have a partner then their photo identity has to be provided as also that of the authorised signatory (who will also sign in Form B)
- Provide a list of food categories that you wish to manufacture
- You have to give an ‘Authority letter’ along with the name and address of the person you nominate and name another alternate person along with their powers and designation in your company. These people will assist the officers who come for inspection, to collect the samples if required, pack and dispatch them.
- Analysis report (Chemical & Bacteriological) of water to be used as ingredient in food from a recognized/ public health laboratory to confirm the portability. The analysis report must have the name of authorized representative of the testing laboratory who collected the sample and must also have the date on which the sample was collected. 9.
- Supply proof (Sale deed/ Rent agreement/ Electricity bill, etc.) that you own the premises
- Partnership Deed/Affidavit/Memorandum & Articles of Association which shows how the firm was constituted.
- You need to provide a recall plan wherever applicable, with details about the person/ persons through whom the product is distributed.
- NOCs from Municipality or local body and from State Pollution Control Board except in case of notified industrial area.
- You have to also provide Food Safety Management System (FSMS) plan or certificate if you have one
The following documents are to be provided if your business will deal with them
- In case your business is a Cooperative then you need to supply a Copy of certificate obtained under Coop Act – 1861/Multi State Coop Act – 2002.
- If you are a re-labeller then an you have to give an NOC from manufacturer
- If you have milk or milk products processing unit then you have to show where you will source your milk from and also procurement plan for milk including location of milk collection centres etc.
- For meat and meat processing plants you have to show the source of the raw material.
- If you are manufacturing packaged water or carbonated water then you have to provide a pesticides residues report of water to be used as ingredient from a recognised/ public health laboratory indicating the name of authorised representative of Lab who collected the sample and date of collecting sample, including source of raw water and treatment plan.
