
It has been reported by BIS that a large number of food importers who are engaged in the business of importing packaged drinking/mineral water are doing so without BIS Certification.
This is to advise all that as per Section 31 of the Food Safety and Standards Act, 2006, all Food Business Operators (FBOs) have to obtain FSSAI Licence before commencement of any food business. Further, as per Regulation 2.3.14 (17) and (18) of Food Safety and Standards (Prohibition and Restriction on Sales) Regulations, 2011,
“ No person shall manufacture, sell or exhibit for sale, packaged drinking water and mineral water except under the Bureau of Indian Standards Certification Mark”.
In view of the above, it is directed that FSSAI licensed importers shall import packaged drinking/mineral water to India only from Foreign Manufacturers who have obtained BIS Certification, list of same is available on the website of BIS (https://bis.gov.in->Conformity Assessment->FMCS->Licensee) which is updated form time to time. The labelling of Packaged Drinking Water or Natural Mineral Water shall be as prescribed under FSS (Packaging and Labelling) Regulations, 2011. Fancy names or abbreviations not to used and names of Products to be in compliance with FSS (Advertising and Claims) Regulations 2018.
All Authorised Officers are directed to ensure that Imported Packaged Drinking/Mineral Water without BIS Certification and other FSSAI requirements are not be cleared through their respective points of entries.
