Question: We are planning to take over one of the hotels in Delhi-NCR, they have valid license of FSSAI. Can we transfer this license in our name?
Answer: You can go for the modification of the license and can go for the change in the company name if all other conditions remain the same. What you can also do is that you can ask for the surrender of the existing license and can apply for a new license in your own company name. Doing a food business without a license is an offence so you have to keep in mind the lag time in between while you surrender your old license and apply for a new one.
Question: I run a Pvt Ltd firm that is into multiple other business activities such as BPO services, educational services etc. I want to enter food preparation business (Catering, meal services restaurant) from 3 locations. Can we register as Pvt. Ltd. firm as FBO, what documents are needed. Will registration do or do I require license?
Answer: Whether you would require a registration or a license, it will depend upon the expected annual turnover. Since, you would be operating from different locations so separate licenses/RCs will have to be acquired for carrying out your food business activities of manufacturing and for further selling & serving to the consumer. Question: Need to start the manufacturing of Spices and Pickles. Do I need to get one license for spices and another license for pickles? Please advice.
Answer: If you just have one facility for manufacturing of Spices & Pickles, then you can apply for just one license and can include all sorts of food business activities in that license. If you have multiple locations in your plan for your food business activities then you have to apply for separate licenses for each of the premises.
Question: Rock salt is a naturally available salt with no process. How to label for rock salt?
Answer: Rock salt is a non-standardized food, so currently there are no standards available under FSSAI regulations. You have to take prior approval from FSSAI for manufacturing, selling & distribution of this food product. Once you apply for the registration of your food business activity then you also have to submit the details about your product along with the proposed label. So, you would be guided for the correct labeling of your product.
Question: WE HAD APPLIED ONLINE FOR MAQNUFACTURER LICENSE Number FROM FSSAI. NOW IN REPLY FSSAI WANT RISK ASSESSMENT OF OUR FORMULATION OF NEUTRACEUTICALS, NOW THE FORMULATION IS ALREADY ESTABLISHED AND AVAILABLE IN MARKET FROM OTHER MANUFACTURER. SO, IS IT NECESSARY TO SUBMIT RISK ASSESSMENT DATA FOR AN ESTABLISHED AND MARKETED FORMULATION????????
Answer: It is the requirement of FSSAI that if someone is involved in the food business activity of manufacturing, selling and distributing etc. of the food products for which currently there are no standards available, one has to comply with all the requirements including risk assessment data as asked by the food regulatory body.
Question: Can I sell my products in other states, if I have a state FSSAI licence? I am going to sale through existing retailers and not through my own shops. I am starting a food business (Agri products) and confused with whether I should take central or state licence?
Answer: If your annual turnover is less than 20 crores then you can apply for a state license. The central license is required to be taken when you have an annual turnover of more than 20 crores Or when you have your food establishments in more than one state. And remember, separate licenses will have to be acquired for separate food business premises.
