Question: My food license will expire on 20th March. Today on 6th March, I am proceeding with my license for renewal. So I want to know is there any penalty as you describe that license should be processed for renewal 30 days prior of expiry?
Answer: Yes, Penalty of Rs100/-per day for the days you consumed out of 30 days.
Question: What is this registration certificate of production capacity up to 100 ltr / kg per day? What is the process of getting it?
Answer: For all food processing units other than dairy, vegetable & meat processing, one shall have to apply for the registration certificate under the FSS Act, Rules & Regulations. A license will be required for such food processing units if the production capacity is more than 100 ltr/kg per day. Now there is an online procedure and one can log in to fssai.gov.in.

Answer: Registration is required when the annual turnover is up to Rs. 12 lacs per annum and one has to apply for the license when the annual turnover is more than Rs. 12 lacs. However, for the processing units, it is the production capacity per day like for a production capacity of up to 100 ltr/kg per day, a registration certificate is required and for the production capacity of more than 100 ltr/kg per day, one will have to apply for the license.

Answer: No, it should be printed on the label.
Question: We wish to import some soy products from Malaysia but are unable to register online as the FPAS website seems to be down. Could you please throw some light on when this will open up for online registration. THERE IS A SCROLLING MESSAGE ON THE WEBSITE SAYING “The FPAS is not operational until further orders”. It is frustrating as we are not able to file for product approval and start our business.
Answer: The advisory on Product Approval was quashed by the Honorable Supreme Court of India. The new regulations in respect of product approval are yet to be finalized.
Question: I am planning to produce some frozen food items at my home (in Ludhiana Punjab) and want to sell to the hotels and restaurants. The turnover will be 10 lacs. Plz, guide me what is required (Registration/license) to operate this type of business and also tell me about the packaging of food items as those will be sold to hotels and restaurants.
Answer: You will have to apply for the registration certificate as your annual turnover will be less than Rs.12 Lacs. You have to comply with the Packaging & Labelling Regulations in compliance with the FSS Act, 2006.
Question: There is one adjudicating matter pending against my brother (FBO) who has died. Whether myself or wife of my brother or his sons are liable for the same, though they were not in the food business?
Answer: If the adjudicating matter is against your brother only; who has died, the case is finished and no one else is liable on his behalf. If the company or the firm is also involved then the adjudicating case will proceed against the firm or company.
Question: Are the rules different in the case of Ayurvedic Proprietary Medicines? I heard it is not compulsory to use veg or non-veg mark in case of these medicines? What about the products where no marking is done?
Answer: They are covered under The Drugs & Cosmetics Act, 1940.
Question: If food is detected as unsafe by the laboratory, and that food is purchased from wholesaler and sample of food is collected from the retail store, then who is responsible; the retailer or the wholesaler?
Answer: It depends upon the circumstances; if the sample has been taken in sealed & original condition by the FSO from the retailer and the cash memo/bill was handed over to the FSO at the time of sampling, then finally by the court or adjudicating officer, the retailer may be spared and the wholesaler/manufacturer may be held responsible.
Question: I want to sell packed milk products like flavored milk and milkshakes in a single state, for now, My turnover will likely be less than 12 lacks, plz tell me whether a registration will be sufficient or will I have to get any other permission?
Answer: For Milk & Milk products, the turnover will be calculated based on the production capacity. In case, if the production capacity is Up to 500 LPD of milk or up to 2.5 MT of milk solids per annum, a registration certificate is required. If the production capacity is: 501 to 50,000 LPD of milk or more than 2.5 MT to 2500 MT
of milk solids per annum, a state license is required to be obtained. If the production capacity is: More than 50,000 liters of liquid milk/day or 2500 MT of milk solid per annum, a central license will have to be acquired.

Yes, you have to apply for the license, assuming the annual turnover of your food business would be more than Rs. 12 Lakhs. If in case, the projected annual turnover not likely to cross Rs. 12 Lakhs then you can apply for the registration certificate.

Sir,we are planning start manufacturing of value added processed products with banana. Should/Can we apply for fss registration/license before the start of manufacturing or can the processing/sale happen alongside the registration process. I assume the procedure takes 45 to 60 days.

If the turnover of your food business is more than 12 lakh per annum so you are not eligible for registration. You should apply for license.
