Through a notification dated 4 June 2020 the FSSAI has issued directions regarding operationalization of the Food Safety and Standards (Prohibition and Restrictions on Sales) Amendment Regulations, 2020 relating to incidental presence of Khesari Gram / Dal.
In the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, the regulation 2.2 specifies “restriction on the use of certain ingredients”: particularly Khesari Gram/ dal (Lathyrus sativus) which is as follows
2.2: Restriction on use of certain ingredient:
2.2.1: No person in any State shall, with effect from such date as the state government concerned may by notification in the official gazette specify in this behalf, sell or offer or expose for sale, or have in his possession for the purpose of sale, under any description or for use as an ingredient in the preparation of any article of food intended for sale:—
(a) Kesari gram (Lathyrus sativus) and its products.
(b)Kesari dal (Lathyrus sativus) and its products.
(c) Kesari dal flour (Lathyrus sativus) and its products.
(d)A mixture of Kesari gram (Lathyrus sativus) and Bengal-gram (Cicer arietinum) or any other gram.
(e) A mixture of Kesari dal (Lathyrus sativus) and Bengal-gram dal (Cicer arietinum) or any other dal.
(f) A mixture of Kesari dal (Lathyrus sativus) flour and Bengal-gram (Cicer arietinum) flour or any other flour
The FSSAI has meanwhile received representations from the State of Madhya Pradesh with regards to the issue of allowing at least 2% of Khesari dal in procurement of grams and pulses. Following which a consultative meeting was held under the Chairmanship of the Hon’ble Minister for Health and Family Welfare with the Hon’ble Minister for Agriculture and Farmers’ Welfare, wherein it was decided to allow 2% Khesari dal including other edible grains as incidental in pulses/ raw pulses.
Accordingly, it has been decided by the FSSAI to operationalise the amendment notification wherein the proviso will be inserted with regard to incidental presence of Khesari Gram/dal (Lathyrus sativus) in pulses not more than 2 percent by mass with immediate effect and till the issuance of the final notification in this regard.
The FSSAI has issued a notice for the immediate operationalisation of the Food Safety and Standards (Prohibition and Restrictions on Sales) Amendment Regulations, 2020. Accordingly, the Food Business Operators shall follow the revised regulations. The enforcement of these regulations shall commence only after the final regulations are notified in the Gazette of India
In the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, the regulation 2.2 relating to Restrictions on use of certain ingredient, under sub-regulation 2.2.1 the following proviso will be inserted
“Provided that the pulses/raw pulses may contain incidental presence of Khesari gram/dal (Lathyrus sativus) including edible pulses/ gains not more than 2 percent by mass.”
