As per Section 31 of the Food Safety & Standards Act, 2006; No food business activity shall be carried out without a valid license/registration. The Licensing/Registration of the food business is regulated under Food Safety & Standards (Licensing & Registration of Food Businesses), Regulations, 2011. FSSAI has already extended the date of compliance for obtaining/conversion of the Food License. In a recent notification, the apex regulator has asked for the suggestions & comments on the proposed amendments in the FSS (Licensing & Registration of Food Businesses) Regulations, 2011.
The apex food regulator has already amended the FSS (Licensing & Registration of Food Businesses) Regulations, 2011 where the date of compliance for obtaining the food license was stated on August 4, 2014 but later on the food authority further issued notifications (Thrice) for extending this deadline and now it is stated to be February 4, 2016.
FSSAI is further looking to amend the existing licensing regulations; as per the latest notification dated 27th November 2015 and which is published on the official portal on December 12, 2015, the food authority is asking for objections & suggestions from all stakeholders from within 60 days from the date in which this notification is made available to the public.
Proposed Amendments:
In Clause (1) of the sub-regulation 2.1.2 of FSS (Licensing & Registration of Food Businesses), 2011:
In the first and the second proviso, where the date of compliance for conversion/renewing of the food license was stated as; “within thirty six months from the date of commencement of these regulations”, instead it shall be read as (if amended) “within fifty four months from the date of commencement of these regulations”. Fifty-Four months would mean that February 4, 2016, if you calculate this period from the date of commencement of the principal regulations for licensing & registration of food businesses.
