Question: I have applied online for FSSAI License on 23rd March 2015 at Delhi which takes approx. 2 months in processing. I am told by FSSAI Office that pending issuance of License, I can do my business. Can I sell my items in the pouches carrying only FSSAI Logo and without License Number? As pouch printing is costly and have to be printed in huge quantity, how to use unutilized pouches after 2 months when I get the license? Or should I wait for 2 months and then get the pouches print showing both FSSAI logo and License No ?
Answer: The time of 60 days has been decided to issue a license as per FSS Act, Rules & Regulations. If no inspection is ordered and the applicant does not hear anything from the registering authority within 60 days, then on the completion of 60 days from the submission of the application form for license, the food business operator shall start the food business activity but he/she is liable to implement the improvement (if any) suggested by the authority even later on.
You need to adhere completely on the FSS (Packaging & Labelling) Regulations. Regarding FSSAI Logo & License No, you have time till June 30, 2015 to follow the guidelines as the date of compliance for the same is July 1, 2015. You can read more:
Question: I have applied for the PA/NOC for my product, I am hopeful to get approval or at least one year NOC With in some time. I want to know that after getting Approval /NOC I can start my business just by getting simple registration? Can I start business from my home?
As I am starting my new business, for initial few months I won’t be crossing the limit of 12 Lakhs or my production won’t be more than 50 kg per day?
And at present I don’t think I can invest in land, & keep one qualified production supervisor at this stage as per the requirement for license. Rest all condition of hygiene & other things can be maintained by me. Please guide.
Answer: After you get the food authority’s nod for the manufacture of your product and if your production capacity is upto 100 Kg per day then you can go for the registration of your product. But if in case, you carry your business activity in the premises in more than one state then your food business will become eligible for the central license because of operations in multiple states.
For carrying out the production activity, there are a set of FSSAI requirements as per Schedule 4 of the Food Safety & Standards Act, 2006, which need to be followed by the food business operators. If you can strictly adhere the guidelines of FSSAI then you can start your business. The food authority may inspect your premises within six months of applying for the license/registration to check if you are following the FSSAI guidelines. A qualified technical person has to be appointed who would be responsible for the production activities.
