
FSSAI has issued an order dated 26 March 2021 regarding requirement of BIS License / application receipt while applying for FSSAI license to manufacture Packaged Drinking Water (PDW) and Mineral Water.
As per Section 31 of the Food Safety and Standards Act 2006, all Food Business Operators (FBOs) have to obtain License / Registration before commencement of any food business. Further regulation 2.3.14 (17) and (18) of the Food Safety and Standards (Prohibition and Restriction on Sales) Regulation 2011, states that “no person shall manufacture, sell or exhibit for sale, packaged drinking water and mineral water except under the Bureau of Indian Standards Certification Mark.” However, FSSAI has received reports that a number of manufacturers of Packaged Drinking Water (PDW) Mineral Water (MW) are operating with FSSAI License but without BIS Certification Mark.
To ensure compliance with the condition of availability of BIS license by the manufacturers of Packaged Drinking Water and Mineral Water, FSSAI has decided to make BIS license / application for BIS license a pre-condition for issuing FSSAI license. Accordingly, the following procedure has been laid down for considering the application for issue of FSSAI License in case of manufacture of PDW and MW.
- FBOs will have to mandatorily upload copy of BIS license or copy of letter indicating recording of application for BIS license at the time of applying for new FSSAI license for PDW and MW from FSSAI on the online system FoSCoS.
- After obtaining the BIS license, the FBO shall furnish its details in the online Annual Return available in FoSCoS.
- BIS license shall be a mandatory document while applying for renewal of license.
- In the event of closure or rejection of application for license by BIS, the FBO shall inform the concerned Licensing Authority and the FSSAI allocation/license is liable to be suspended / cancelled.
This order shall come into effect from 1 April 2021
