The FSSAI has issued guidelines on enforcement of the Food Safety and Standards (Advertising and Claims) Regulations, 2018 on 26 October, 2021. The apex body for food safety and standards has considered its earlier directions on 28 June 2019 and 7 September, 2021 as ineffective.
The stakeholders have sent representations to FSSAI clamouring against nullifying the earlier directions as the Food Business Operators (FBOs) have already started following the operationalised amendment regulations. The transitory phase of regulatory compliance with provision of the amendment regulation has led to several confusions among FBO’s. To ensure consumer’s interest and fair practices in food business operations and the fact that draft regulations are still in the process of notification and final denouement in the meanwhile the FSSAI has decided to;
- Enforce the Food Safety and Standards (Advertising and Claims) Regulations 2018 with immediate effect.
- Re-operationalise the Food Safety and Standards (Advertising and Claims) Amendment Regulations 2021. Food Business Operators shall comply with these amendment regulations by 1 July, 2022
Suffice is to say that these directions supersede the previous directions dated 28 June, 2019 and 7 September 2021.
